1. Copyright Infringement Claims

Game Zone respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our website (the "Site") that are reported to our Designated Copyright Agent.

If you are a copyright owner, or authorized to act on behalf of one, and you believe that copyrighted work has been copied in a way that constitutes copyright infringement on our Site, please submit your claim via email to our DMCA Agent with the information outlined below.

2. How to File a DMCA Notice

To file a proper DMCA takedown notice, you must provide a written communication that includes the following information:

  1. Identification of the copyrighted work: Identify the copyrighted work that you claim has been infringed, or if multiple copyrighted works on our Site are covered by a single notification, provide a representative list of such works
  2. Identification of the infringing material: Identify the material that you claim is infringing and that you want removed or access to which you want disabled, and provide information reasonably sufficient to permit us to locate the material (e.g., the URL of the page containing the material)
  3. Your contact information: Provide your full legal name, mailing address, telephone number, and email address
  4. Statement of good faith: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  5. Statement of accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
  6. Physical or electronic signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf

4. Counter-Notification Procedure

If you believe that the material that was removed or to which access was disabled is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to use the material, you may send a counter-notification to our DMCA Agent containing the following information:

  1. Identification of the material: Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled
  2. Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material
  3. Your contact information: Your name, address, telephone number, and email address
  4. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Game Zone may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person
  5. Physical or electronic signature: Your physical or electronic signature

Upon receiving a valid counter-notification, we will forward it to the party who filed the original complaint. If the original complainant does not file a court action against you within 10-14 business days of receiving the counter-notification, we will restore the removed material.

5. Repeat Infringers Policy

In accordance with the DMCA and other applicable law, Game Zone has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users or account holders who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Site and/or terminate the access of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

We define a "repeat infringer" as any user who has been the subject of more than two valid DMCA takedown notices. Upon identification of a repeat infringer, we reserve the right to:

Game Zone reserves the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site following any changes indicates your acceptance of the modified policy.
